Fronteras de inclusión diferencial: Subjetividad y luchas en el umbral de los excesos de justicia

Abstract

The article proposes a critical analysis of the relation of justice and borders, starting from the assumption that borders no longer exist at the edge of the territory, marking the point where it ends, but have been transported into the middle of political space. Bringing together Marx’s and Foucault’s criticisms of the liberal theory of justice and their perspectives on the production of subjectivity, the article explores some of the multifarious transformations of the border and migration “regime” that can be observed in several parts of the globe and contend that an analysis of the relationship of justice and borders, which has hitherto focused on the binary inclusion/exclusion, now needs to be enlarged to grasp the emerging mechanisms of “differential inclusion”, as well as the political significance of “border struggles” in our global world in the context of the urge for justice now being evidenced in all situations and sites of existence on the borders.; El texto realiza un análisis crítico de la relación entre justicia y fronteras asumiendo que éstas ya no ocupan solo el confín del territorio sino que se han trasladado al corazón del espacio político. Reuniendo las críticas de Marx y Foucault a la teoría liberal de la justicia y sus perspectivas sobre la producción de subjetividad, el artículo explora algunas de las múltiples transformaciones de la frontera y los regímenes de migración que pueden ser observados en varias partes del mundo. Plantea asimismo que un análisis de la relación entre justicia y fronteras, que hasta ahora se ha venido focalizando en el binarismo inclusión/exclusión, necesita ser ampliado para captar los mecanismos emergentes de “inclusión diferencial” y el significado de las “luchas de frontera” en nuestro mundo global en el contexto del reclamo de justicia que está siendo evidente en todas las situaciones y lugares de fronter.
