La violencia contra las mujeres desde una perspectiva histórico-jurídica: España , México y Perú
Abstract
[ES]El presente trabajo es un estudio de la situación de la mujer en diferentes ámbitos de la sociedad, tanto en España como en Perú
y México, desde la Baja Edad Media hasta finales del siglo XX, con el fin de entender y analizar la violencia ejercida contra la mujer
en los diferentes momentos. Para llevarlo a cabo de forma clara y estructurada, hemos dividido toda esta época en 3 grandes
bloques: Ius commune, siglo XIX y siglo XX, si bien en el capítulo en el que estudiamos los códigos penales y civiles de los dos
últimos siglos, diferenciaremos entre la primera y segunda mitad del siglo XX, dada la importancia de los cambios legislativos que
se llevaron a cabo en ese parte final del siglo y que afectaron a la situación y condición de la mujer. La causa de esta división
cronológica radica en el objetivo principal del trabajo, que es es estudiar la consideración jurídico, legal y social que recibe la
mujer española y americana en cada una de estas épocas, así como identificar los avances o no que hubo con respecto a ellas en
cada uno de los diferentes códigos y constituciones que examinaremos. De esta forma, se visualizarán las condiciones y derechos
de la mujer en la esfera pública y privada, los derechos y obligaciones otorgados por los diferentes textos y la discriminación de
trato que sufrían en comparación con los hombres, entre otras cuestiones.
El trabajo comienza con un estudio sobre la disicriminación de la mujer a lo largo de la época bajomedieval hasta el final del
Antiguo Régimen (Ius Commune) por medio de: un estudio de la distinción de género en los textos jurídicos de la época (imagen
proyectada), palabras y términos empleados para incluir o no a la mujer (el lenguaje) y el tipo de formación y disciplina ejercida
por parte de los educadores sobre las niñas (la educación).
Con el propósito de estudiar el trato que recibían las mujeres españolas, en este trabajo nos centraremos en el caso de la mujer
castellana, dado que se trata del derecho de mas expansión de la península ibérica, y que a su vez fue el llevado a América por
medio del derecho indiano, lo que nos es de gran ayuda a la hora de entender y estudiar la situación de la mujeres indígenas y
americanas de esta época.
Una vez comprendida la situación de la mujer castellana e indiana sobre la base de lo establecido por el Ius Commune, así como
por las diferentes costumbres y leyes de la sociedad de la época, nos centraremos en las Constituciones que se fueron elaborando
y promulgando a lo largo de los siglos siglos XIX y XX, enfatizando la capacidad otorgada o no de la mujer para ser considerada
“ciudadana” al ser este derecho completamente necesario para poder a aspirar a diferentes libertades, obligaciones y derechos,
así como en los Códigos penales y Civiles con el fin de detallar las penas, atenuantes y agravantes que sufrían las mujeres a la
hora de ser juzgadas o ser víctimas de los diferentes delitos y violencia ejercida sobre ellas.
Como conclusión, se ha obtenido que este método comparativo es muy útil para apreciar de forma clara y concisa los aspectos
comunes de los diferentes textos en cada época, si bien en otros casos se ha observado que la forma de tipificar los delitos no
tienen nada que ver en un país y en otro. [EN]This project is a study of the situation of women in different areas of society, both in
Spain and in Peru and Mexico, from the Late Middle Ages to the end of the XX century
in order to understand and analyze the violence against women at different periods of
time. In order to carry it out in a clear and structured way, we have divided this entire
period into 3 different periods: Ius commune, XIX century and XX century, although in
the chapter in which we study the Penal and Civil codes of the last two centuries, we
will differentiate between the first and second half of the XX century, given the
legislative changes that took place at the end of the century and which affected the
situation and condition of women. The reason for this chronological division lies in the
main objective of the work, which is to study the legal, juridical and social treatment of
spanish and Indigenous women in each of these periods, as well as to identify the
progress or lack of it in each of the different Codes and Constitutions that we will
examine. In this way, we will visualize the conditions and rights of women in the public and private sphere, the rights and obligations granted by the different texts and the
discriminatory treatment they suffered compared with men, among other issues.
The work begins with a study of the discrimination against women throughout the
late-medieval period up to the end of the Former Regime (Ius Commune) through: a
study of the gender distinction in the legal texts of the time (projected image), words
and terms used to include or not women (the language) and the type of training and
discipline exercised by educators on girls (the education).
In order to study the treatment received by Spanish women, in this work we will focus
on the case of Castilian women, since the law exercised in this region was the most
widespread in the Iberian Peninsula, and that this in turn was taken to America by
means of Indian law, which is of great help to us when it comes to understanding and
studying the situation of indigenous women at that time.
Once we have understood the situation of Castilian and Indian women based on what
was established by the different laws of the lus Commune, as well as the different
customs of the society of that time, we will focus on the Constitutions that were drawn
up and promulgated throughout the XIX and XX centuries, emphasising on the capacity
or not of women to be considered "citizens", as this right is completely necessary to be
able to aspire to different freedoms, obligations and rights, as well as on the Penal and
Civil Codes in order to detail the penalties, mitigating and aggravating factors that
women suffered when being judged or being victims of the different crimes and
violence exercised on them.
In conclusion, we can say that this comparative method is very useful in order to
appreciate the common aspects of the different texts in each period in a clearly and
concisely way, although in other cases it was observed that the way in which the
offences are typified has nothing to do with one country and another.
