El conflicto de roles con respecto a la prueba pericial psicológica en el proceso judicial

Abstract
The article analyzes the contribution of psychological expert evidence to the judicial process, as well as the different roles played by psychologists. The different issues on which it is possible to request an opinion from a psychologist are described and the procedural role of the psychologist in the trial is assessed. The scope of professional secrecy is analyzed when the psychologist acts as a forensic psychologist or as an expert witness psychologist. The different duties and responsibilities of psychologists and judges in court proceedings are dealt with. It is important for psychologists to recognize both the obligations and limitations of their responsibilities when testifying. Finally, current difficulties and role conflicts are pointed out and the main future challenges for the research in this controversial field are indicated. El artículo analiza la aportación de la prueba pericial psicológica al proceso judicial, así como los diferentes roles desempeñados por los psicólogos. Se describen los diferentes temas sobre los que cabe solicitar un dictamen a un psicólogo y se
valora el rol procesal del psicólogo en el juicio, con especial mención a las diferencias entre su actuación como testigo-perito o su aportación como perito desde la perspectiva del secreto profesional. Asimismo se profundiza en las diversas funciones del perito y del juez en un proceso para garantizar un espacio procesal en el que el perito aporta un conocimiento especializado para coadyuvar a la decisión y el juez resuelve de forma argumentada el conflicto en el que se ha contado
con la aportación del perito. Finalmente se señalan los conflictos de roles existentes actualmente y los principales retos de futuro en el ámbito de los dictámenes periciales.
