[eng] The aim of this work is to analyze whether the protection that the Spanish legal system
grants to animal welfare is adequate or if, on the contrary, it requires improvement.
Attending to that purpose, the evolution of Spanish legislation on the protection of
animals has been analyzed, paying special attention to criminal law field. To continue,
different theories have been analyzed with the aim of delimitating the legal right.
Furthermore, an exhaustive analysis of the specific types has been made: the crime of
animal abuse and the crime of abandonment of animals, regulated in articles 337 and 337
bis CP, respectively. It reflects both the novelties and the shortcomings observed, all of
which are key issues in the final conclusions. On the other hand, special attention is paid
to the wide administrative regulation that exists, and consequently to the Preliminary draft
of the Law for the Protection and Rights of Animals created with the purpose of
overcoming the great divergence existing in this country. Finally, the use of animals in
the field of experimentation is analyzed, highlighting the recent case of the Vivotecnia
laboratory, which shows that there´s still a long way to go.
