Violencia de género en el marco de la sustracción internacional de menores

La sustracción internacional de menores es un fenómeno cada vez más presente en la
sociedad actual que consiste en el traslado o retención de un menor de un país a otro
vulnerando un derecho de custodia. Este problema no es nuevo, pero se da cada vez con más
frecuencia. El incremento se debe a diferentes factores: por un lado, la globalización, que
favorece la internacionalidad de matrimonios y parejas, y la movilidad entre diferentes países
y, por otro lado, la tendencia de las regulaciones estatales de favorecer los divorcios o
separaciones y a atribuir la custodia de los hijos a ambos progenitores.
Existen varios textos normativos en el ámbito de Derecho Internacional Privado que
regulan el secuestro y en particular, el procedimiento de retorno para conseguir que el menor
vuelva al país de residencia habitual anterior al traslado. El problema reside en que
actualmente se observa un cambio en el tipo de sustractor1
. La normativa aplicable a la
sustracción internacional de menores se desarrolló en una época y realidad muy diferentes a
los actuales. El prototipo de sustractor en el que se pensaba en la redacción de los textos sobre
sustracción internacional de menores de esa época era el de un progenitor que no tenía
derecho de custodia
.
