Abstract

[EU]Krimen arloko politikak azken hamarkadetan hartu duen joera zigortzailea kontuan izanda, gradu amaierako Ian honen bitartez biziarteko espetxe-zigor berrikusgarriaren azterketa burutu nahi da. [EN] Taking into account the punitive tendency that criminal policy has acquired in recent decades, this end-of-degree work is intended to carry out an analysis on the reviewable permanent prison. This will include an analysis of its scope; an investigation of the Constitutional Court's ruling and the individual votes contained therein; a look at the case law of the European Court of Human Rights; and comparative law will be worked on to compare its different applications at European level. On the other hand, an analysis of the growing trend of punitivism will be made and the strength of punitive populism will be observed to become aware of its importance in criminal reforms. To this end, a review of the situation will be done, carrying out a study of existing empirical analyses in this area.

[ES]Teniendo en cuenta la tendencia punitiva que ha adquirido la política criminal en las últimas décadas, con este trabajo de fin de grado se pretende Ilevar a cabo un análisis sobre la prisión permanente revisable. Para ello se analizará, por un lado, su åmbito de aplicación; se investigará la sentencia del Tribunal Constitucional y Ios votos particulares que en ella figuran; se echará un vistazo a la jurisprudencia del Tribunal Europeo de Derechos Humanos; y se trabajará el Derecho comparado para comparar sus diferentes aplicaciones a nivel europeo. Por otro lado, se realizará un análisis de la tendencia creciente del punitivismo y se observará la fuerza del populismo punitivo para tomar conciencia de su importancia en las reformas penales. Para ello, se Ilevará a cabo una revisión de la situación, realizando un estudio de los análisis empíricos existentes en la materia.
