El desafío de la delicuencia juvenil en Euskadi: reforma, problemática e impacto en la realidad

Abstract

[ES]Gran parte de la sociedad de hoy en día está concienciada y medianamente informada de lo que ocurre actualmente con el fenómeno de la delincuencia juvenil. Hablamos de un fenómeno que genera gran controversia, miedo, inseguridad y, sobre todo, distintas opiniones y consideraciones acerca del mismo. Se puede afirmar, de acuerdo a los intereses generales y a las noticias que bombardean las redes sociales cada día, que según va evolucionando el tiempo que recorre, la delincuencia, si no es creciente, es cada vez más preocupante en la comunidad en la que convivimos. El término de convivir ya nos hace dudar sobre a qué es a lo que nos estamos refiriendo. El compartir grandes rasgos y ámbitos de nuestra vida con los demás nos hace formar parte de una comunidad, de la sociedad. Por ello, la optimización de que la seguridad y los buenos hábitos residan con nosotros es fundamental. Pero, contradiciéndonos, hoy en día rara vez nos sentimos seguros conviviendo con los demás.

Es importante resaltar que desde años atrás hay varias acciones y fenómenos que nos hacen dudar de la seguridad de la sociedad y, mismamente, de nosotros mismos. Podemos hablar sobre el maltrato en todos sus aspectos: el bullying, el fracaso escolar y laboral, la violencia intrafamiliar, la violencia de género, el tráfico de animales y drogas, y muchos otros más con los que hoy en día, si no los vivimos de cerca o en primera instancia, poco nos importa más que lo que vemos y escuchamos en las noticias. Es, por tanto, que, dentro de la índole de los anteriores, entra la delincuencia de menores, tema muy preocupante hoy en día y que se debe resaltar, al igual que todos los mencionados anteriormente, cuando hablamos sobre seguridad y sociedad.

Es importante conocer y dar a conocer el fenómeno de la delincuencia juvenil ya que nos encontramos ante un paradigma que está en constante cambio, revisión y evolución. Hoy en día la juventud crece y se revoluciona desde edades más tempranas, pudiendo llegar a actos que preferiblemente llamaríamos como ilegales. No son pocos los casos que podemos observar en el día a día, tanto como en las redes sociales, y todo ello teniendo en cuenta que estamos hablando de un rango de edad en el que los cambios para conseguir una personalidad y un estatus son primordiales para muchos. 5 El estudio empírico generado a continuación permitirá dar valor a estas cualidades y variables psico-socio-educativas que tanto cuesta conocer. La legalidad, la judicialidad y los procesos penales de esta situación pueden aportar nuevas ideas y opiniones a la hora de reconocer esta manifestación que tan importante es.

Y ya no hablamos tanto de parar definitivamente y cortar de raíz este fenómeno, dando por hecho que esta cuestión es imposible de gestionar. Más que todo este revuelo, lo que realmente necesitamos es conseguir frenar de manera educativa a un menor que no está actuando de acuerdo a una conciencia positiva, beneficiosa y empática para toda la comunidad, tanto para gente cercana como para perfectamente desconocidos.

[EN]A large part of today's society is aware AND moderately informed of what is currently happening with the phenomenon of juvenile delinquency. We are talking about a phenomenon that generates great controversy, fear, insecurity and, above all, different opinions and considerations about it. It can be affirmed, according to the general interests and the news that bombard the social networks every day, that as time goes by, delinquency, if not growing, is more and more worrying in the community in which we live. The term "living together" already makes us doubt what we are referring to. Sharing major features and areas of our lives with others makes us part of a community, of society. This is why optimizing that safety and good habits reside with us is fundamental. But, contradicting ourselves, nowadays we rarely feel safe living with others.

It is important to emphasize that since years ago there are several actions and phenomena that make us doubt the safety of society and even of ourselves. We can talk about mistreatment in all its peaks, bullying, school and work failure, domestic violence, gender violence, animal and drug trafficking, and many others that today, if we do not live them closely or in the first instance, we can easily abolish them from our minds. Within these phenomena also enters the juvenile delinquency, a very worrying issue today 6 and that should be highlighted, like all those mentioned above, and put measures, if not an end, to all of them.

It is important to know and make known the phenomenon of juvenile delinquency since we are facing a paradigm in constant change, revision and evolution. Nowadays, youth is growing and revolutionizing from an early age, being able to reach acts that we would preferably call illegal. There are not few cases that we can observe in the day to day, as well as in social networks, and all this taking into account that we are talking about an age range in which the changes to achieve a personality and a rough and primordial status are sensibly little recognized.

The study generated below will allow us to give value to these qualities and psycho/social/educational variables that are so difficult to proliferate. The legality, the judicial and dad and the penal processes of this situation that we will know can contribute new ideas and personal managements at the time of recognizing this phenomenon that is so important.

And we are no longer talking so much about definitively stopping and nipping this phenomenon in the bud, given the fact that this issue is impossible to manage. More than all this commotion, what we really need is to manage to curb in an educational way a minor who is not acting according to a positive, beneficial and empathetic conscience for everyone who drives in his circle.
