Análisis jurídico de los smart contracts desde la perspectiva del derecho internacional privado

Abstract

[ES]Los Smart contracts han tenido un impacto significativo, con millones de registros en la Blockchain de Ethereum y un importante volumen de transacciones de criptomonedas en España, lo que evidencia el alcance de esta tecnología. Este trabajo se enfoca en examinar las transacciones realizadas mediante Smart contracts y su cabida legal, tanto en la compraventa de cripto activos como en las contraprestaciones mediante Blockchain, analizando la necesidad de regulación específica y considerando el marco del Derecho Internacional Privado debido a la naturaleza internacional de esta tecnología.

[EN]Smart contracts have had a significant impact, with millions of registrations on the Ethereum Blockchain and a significant volume of cryptocurrency transactions in Spain, which shows the reach of this technology. This paper focuses on examining the transactions carried out through Smart Contracts and their legal scope, both in the purchase and sale of crypto assets and in the counterparties through Blockchain, analyzing the need for specific regulation and considering the framework of Private International Law due to the international nature of this technology.
