Introducción al nuevo Código Penal español: líneas directrices y contenido fundamental

Abstract

[ES] La Constitución de 1978 evidenció la urgencia de un nuevo Código Penal que se adecuara a la nueva situación política, social y jurídica, máxime si tenemos en cuenta que el antiguo, aún con modificaciones, hundía sus raíces en la primera mitad del siglo pasado. Sin ser perfecto, puede decirse que el nuevo código, aprobado en 1995, responde, en lo esencial, a las necesidades de una sociedad moderna en el ámbito criminal y penal.

[EU] 1978ko Konstituzioak argi erakutsi zuen Kode Penal berri baten premia, egoera politiko, sozial eta juridiko berrira egokituko zena, ordura arte zegoenaren sustraiak aurreko mendeko lehen erdikoak baitziren, nahiz eta zenbait aldaketa eginak zituen. Perfektoa izan ez arren, kode berria, 1995ean onartua, gizarte modernoak arlo kriminalean eta penalean dituen beharrizanei oinarrian erantzuteko nahikoa dela esan dezakegu.

[EN] The 1978 Constitution has posed the urgency for a new Penal Code which adapts to the new political, social and judicial situation, all the more so if we take into account that the former Constitution, even with modifications, embedded its roots within the first half of the past century. Without being perfect, it could be said that the new Code, passed in 1995, responds, in the essential matters, to the requirements of a modern society in the criminal and penal sphere.

[FR] La Constitution de 1978 a mis en évidence l’urgence d’un nouveau Code Pénal qui s’adapte à la nouvelle situation politique, sociale et juridique, à plus forte raison si nous tenons compte du fait que l’ancien Code, toujours exposé à des modifications, était enraciné dans la première moitié du siècle dernier. Sans être parfait, on peut dire que le nouveau code, adopté en 1995, répond essentiellement aux nécessités d’une société moderne en matière criminelle et pénale

[GR] Die gesetzgebung von 1978 machte deutlich daß man sehr schnell ein neues Strafgesetzbuch braucht, was sich besser an die heutige politische, soziale uns juridische Situation an paßt, vor allem wenn wir berücksichtigen daß die alte Gesetgebung selbst mit Änderungen noch aus die erste Hälfte des vorigen Jahrhunderts Stammt. Ohne vollkommen zu sein, können wir sagen daß das neue Strafgesetzbuch wesentlich an die Bedürfnisse einer modernen Gesellschaft beant wortet auf straf- und verbrecherisch Gebiet.
