La nueva normativa cubana de cooperativas no agropecuarias

Abstract

2012. urtean, lehen aldiz Iraultza ondoren, eta Alderdi Komunistaren VI Kongresuan onarturiko "Alderdiaren eta Iraultzaren Politika Ekonomiko eta Sozialaren Lerro"ekin bat eginez, nekazaritza arlokoak ez diren kooperatibei buruzko barne araudia onartu zen.Gobernuak modu esperimentalean sorturiko dekretu eta lege-dekretuak dira, etorkizuneko Kooperatiben Lege Orokorra heldu bitartean. Espero daiteke etorkizuneko Lege Orokorrak akats txiki horiek konpontzea, Estatuari kooperatiben sustapen funtzioa utziz, eta kooperatibistek erantzukizuna beregana dezatela kooperatibaren sorrera eta bizitzan zehar.; Regulations relating to non-farming cooperatives in accordance with the "Directives of Economic and Social Politics of the Party and the Revolution" -approved in the VI Congress of the Communist Party- were published in 2012 for the first time since the Revolution.These decrees and rules, drafted in prevision of the future General Law on Cooperatives, represent an enormous move forward mainly because they allow for the formation of Cooperatives in sectors other than farming which will help find jobs for thousands of unemployed individuals whilst providing them with legal coverage, at the same time allowing the State to concentrate on the fundamental means for production. However, after analyzing the document and in light of other decrees and the General Law published by the ACI Americas, certain deficiencies may be observed, such as the continuous control by the State throughout all of the phases of the Cooperative's life. It is to be expected that these small deficiencies will be corrected in the future General Law, leaving the State to advertise and promote the Cooperatives and that the Members of the Cooperative be those whom take on more responsibility during both the Constitution Phase as well as throughout the life of the Cooperative.; En 2012 se promulga por primera vez después de la Revolución, y, de acuerdo con los "Lineamientos de la Política Económica y Social del Partido y la Revolución" aprobados en el VI congreso del Partido Comunista, una normativa relativa a cooperativas no agropecuarias.Estos decretos y decretos leyes dictados por el Gobierno con carácter experimental en previsión de una futura Ley General de Cooperativas, representan un gran avance, principalmente por el hecho de permitir la constitución de cooperativas en sectores de la economía distintos del agropecuario, y ayudar a incorporar al trabajo miles de desempleados, dándoles una cobertura legal, para que el Estado se pueda centrar en los medios fundamentales de producción. Sin embargo, su análisis, a la luz de otras legislaciones y de la Ley Marco publicada por la ACI Américas, permite observar ciertas deficiencias, como el mantenimiento del control estatal en todas las fases de la vida de la cooperativa. Es de esperar que la futura Ley General, subsane estos pequeños defectos dejando al Estado la promoción y fomento de las cooperativas, y que los propios cooperativistas asuman más responsabilidad tanto en la fase de constitución como durante la vida de la cooperativa.
