Innovaciones sociales en materia de vivienda y Economía Social: reflexiones desde el Derecho Financiero y Tributario

Abstract

El derecho a una vivienda digna es uno de los derechos sociales que mayores problemas plantea en la sociedad actual, siendo muchas las personas para las que más que un derecho efectivo es una quimera. La necesidad de buscar soluciones que contribuyan a su efectividad es apremiante, como también lo es realizar un esfuerzo intelectual sobre la trascendencia del Derecho, y más concretamente el Derecho Financiero, en la incentivación de innovaciones sociales que ayuden a que una de las condiciones básicas para la dignidad humana, el disponer de una morada, se cumpla en la forma debida. Partiendo de esta premisa, pretendemos reflexionar sobre el papel de la economía social como sujeto activo de innovaciones sociales relacionadas con la vivienda, y principalmente sobre el reconocimiento que tal actividad debe obtener desde la perspectiva del ingreso y del gasto público. Entendemos que es necesario que las políticas públicas, y especialmente la política fiscal, tengan en cuenta que junto con las actuaciones públicas en materia de vivienda, las soluciones aportadas por la Economía Social al problema de la vivienda redundan en el bienestar de un gran número de personas. Se analizan también las innovaciones sociales relacionadas con la financiación de la Economía Social, prestándose especial atención al denominado crowdfunding.; Etxebizitza duinerako eskubidea, gaur egungo gizartean, arazo gehien planteatzen dituen gizarte eskubideen artean dago. Askorentzat, benetako eskubidea baino gehiago, ameskeria edo kimera da. Premiazkoa de benetako eskubidea bihurtu dadin konponbideak bilatzea eta, baita ere, eskubidearean garrantziaren inguruko saio intelektuala egitea. Zehazki, finantza zuzenbideak gizarte berrikuntzak sustatu behar ditu, etxebizitza edukitzeko eskubidea, giza duintasunerako oinarrizko baldintza izanik, benetakoa izan dadin. Hortik abiatuta, gizarte ekonomiak etxebizitzaren inguruko gizarte berrikuntzak bultzatzeko duen funtzioaz hausnartu nahi dugu. Batez ere, jarduera horrek eduki behar duen aitorpena sarrera eta gastu publikoen ikuspegitik. Uste dugu beharrezkoa dela politika publikoek, bereziki politika fiskalak, kontuan hartzea, etxebizitza alorreko jarduera publikoetaz gain, gizarte ekonomiak etxebizitzaren arazoari emandako irtenbideek pertsona kopuru handi baten ongizatea eragiten dutela. Gizarte ekonomiaren finantziaketarekin harremana duten gizarte berrikuntzak ere aztertuko ditugu, bereziki crowdfunding delakoa.; The right to adequate housing is one of the social rights that poses major problems in today's society, and for many people more than a right is a chimera. The need to find solutions that contribute to its effectiveness, and also to make an intellectual effort on the importance of the law, more specifically the Financial Law, are compelling, in encouraging social innovations that help to one of the basic conditions for human dignity, the availability of a dwelling, was fulfilled in due form. On this basis, we intend to consider on the role of the social economy as active subject of social innovations related to housing, and mainly on the recognition that such activity must obtain from the perspective of income and public spending. We understand the need for a public policy, especially tax policy, which keep in mind that along with public actions in housing, the solutions provided by the Social Economy to the housing problem result in the welfare of a large number of people. The social innovations related to the financing ot he Social Economy, with particular attention to the so called crowdfunding, are also analyzed.
