El derecho a un Tribunal imparcial: su interpretación a la luz del caso Bateragune

[SPA] El 6 de noviembre del 2018, el Tribunal Europeo de Derechos Humanos reconoció que se
había vulnerado el derecho a un tribunal imparcial en el llamado “caso Bateragune”,
concretamente, por la presencia de la magistrada Ángela Murillo en el órgano colegiado que
condenó a los acusados por ser miembros y dirigentes del grupo terrorista ETA. A raíz de
dicha sentencia, se ha reabierto el debate en torno al derecho a que una causa sea juzgada
por un tribunal imparcial, y las consecuencias que, en el ordenamiento jurídico español, tiene
una declaración de vulneración de dicho derecho por el tribunal de Estrasburgo.
Por ello, en el presente trabajo analizaremos el derecho a un tribunal imparcial, tomando
como punto de partida el caso Bateragune. Tras desarrollar el iter procesal del caso,
estudiaremos el citado derecho, tanto desde la perspectiva del Tribunal Supremo y el Tribunal
Constitucional, como desde la doctrina del Tribunal Europeo de Derechos Humanos,
analizando, al mismo tiempo los criterios en concreto aplicados. Además, se tratará
brevemente el juicio de revisión y la posibilidad de que, tras 12 años desde el inicio de la
investigación de los hechos, se reabra el procedimiento, dándose así un nuevo enjuiciamiento. [EUS] 2018ko azaroaren 6an, Giza Eskubideen Europako Auzitegiak "Bateragune auzia"
delakoan auzitegi inpartziala izateko eskubidea urratu zela aitortu zuen, zehazki, Ángela
Murillo epailearen pertsonan, akusatuak ETA talde terroristakoak izateagatik eta
zuzentzeagatik gaitzetsiz. Aipatutako ebazpenaren ondorioz, auzitegi inpartzial batek auzia
epaitzeko eskubideari buruzko eztabaida ireki da, baita eskubide hori urratu izanaren
deklarazioaren ondorioei buruzkoa ere.
Hori dela eta, aipatutako eskubidea aztertuko da, Bateragune kasua abiapuntutzat hartuta,
bai Auzitegi Gorenaren eta Konstituzio Auzitegiaren ikuspegitik, bai Giza Eskubideen
Europako Auzitegiaren aldetik. Horrez gain, berrikuspen-epaiketa eta gertaeren ikerketa hasi
zenetik 12 urte igaro ondoren prozedura berriro irekitzeko aukera aztertuko dugu.. [ENG] On November 6th, 2018, the European Court of Human Rights recognized that there was
a violation of the right to a fair trial in the “Bateragune” case, specifically, in the person of Judge
Ángela Murillo, by condemning the accused for being members and leaders of the terrorist
group ETA. As a result of said ruling, the debate has been reopened regarding the right to
have a case tried by an impartial court, and the consequences of the declaration of a violation
of said right.
For this reason, in this paper the aforementioned right will be analyzed, taking the
“Bateragune” case as a starting point, both from the perspective of the spanish Supreme Court
and the Constitutional Court, as well as from the perspective of the European Court of Human
Rights. In addition, the possibility of a review trial and that, after 12 years from the beginning
of the investigation, the procedure will be reopened, thus giving a new trial, will also be
analysed.
