La protección jurídica de los animales. Especial consideración de la tutela penal

[spa] El presente Trabajo tiene por objeto analizar si la protección que el Ordenamiento Jurídico español otorga al bienestar animal es la adecuada o si, por el contrario, precisa de una mejora. Con este propósito, se ha analizado la evolución que ha experimentado la legislación española en materia de protección de los animales, prestando especial atención a la tutela jurídico penal. Para continuar, se han estudiado las distintas teorías existentes en torno a la delimitación del bien jurídico. Seguidamente, se ha realizado un análisis de los tipos concretos, esto es, del delito de maltrato animal y del delito de abandono de animales, regulados en los artículos 337 y 337 bis CP, respectivamente. En el mismo, se reflejan tanto las novedades como las carencias observadas, todas ellas cuestiones protagonistas en las conclusiones finales. Por otro lado, se presta especial atención a la amplía regulación administrativa existente en este aspecto, y consecuentemente se analiza el Anteproyecto de Ley de Protección y Derechos de los Animales creado a los efectos de superar la gran divergencia existente en España. Finalmente, se analiza el empleo de animales en el campo de la experimentación, donde se pone de relieve el caso del laboratorio de Vivotecnia, suscitando así un suceso muy reciente y llamativo, que denota que aún falta un gran camino por recorrer.

[eng] The aim of this work is to analyze whether the protection that the Spanish legal system grants to animal welfare is adequate or if, on the contrary, it requires improvement. Attending to that purpose, the evolution of Spanish legislation on the protection of animals has been analyzed, paying special attention to criminal law field. To continue, different theories have been analyzed with the aim of delimitating the legal right. Furthermore, an exhaustive analysis of the specific types has been made: the crime of animal abuse and the crime of abandonment of animals, regulated in articles 337 and 337 bis CP, respectively. It reflects both the novelties and the shortcomings observed, all of which are key issues in the final conclusions. On the other hand, special attention is paid to the wide administrative regulation that exists, and consequently to the Preliminary draft of the Law for the Protection and Rights of Animals created with the purpose of overcoming the great divergence existing in this country. Finally, the use of animals in the field of experimentation is analyzed, highlighting the recent case of the Vivotecnia laboratory, which shows that there´s still a long way to go.
