Abstract

[EU] Erabilera Turistikoko Etxebizitzek erronka ekonomiko eta sozialak sortzen dituzte, eta haien gorakada geldiezinak aurrera egin ahala, eztabaida handia eragiten dute. Gaur egungo gizartearen parte dira jada, eta horregatik, azterlan honetan aztertuko dira gai honen inguruan sortzen diren interes-gatazkak eta jabetza horizontaleko eraikinetan sortzen dituzten arazoak, horietan inbertitzea erabakitzen duten jabeentzako errentagarritasun ekonomikoaz haratago. [ES] Las Viviendas de Uso Turístico plantean retos económicos y sociales que, a medida que avanza su imparable auge, generan un gran debate. Como ya forman parte de la sociedad actual, en este estudio se analizarán los conflictos de intereses que se suscitan en esta materia y los problemas que plantean en los edificios de propiedad horizontal, más allá de la rentabilidad económica para los propietarios que deciden invertir en ellos. Se investigará el régimen jurídico estatal y el que se aplica en las comunidades autónomas, así como las respuestas o soluciones jurisprudenciales.

[EN] Housing for tourist use poses economic and social challenges that, as its unstoppable boom continues, are generating a great deal of debate. As they are already part of today's society, this study will analyse the conflicts of interest that arise in this area and the problems they pose in horizontal property buildings, beyond the economic profitability for the owners who decide to invest in them. It will investigate the state legal regime and that which is applied in the autonomous communities, as well as the responses or jurisprudential solutions.
