El sistema penal : su legitimidad axiológica, contextual y teleológica

Abstract

[ES] Se analiza la legitimidad del sistema penal en tres vertientes: la axiológica, la contextual y la teleológica. En el orden axiológico se reivindica su función de protección exclusiva de bienes jurídicos mediante la prohibición de conductas materialmente ofensivas. En el plano contextual se requiere una intervención que no sea tan tardía que excluya o debilite la necesidad de la pena. En el orden teleológico se precisa que la sanción penal garantice, con el menor nivel de aflicción posible, la vigencia de la ley, la protección de la víctima y la reincorporación comunitaria del infractor.

[FR] L’auteur analyse la légitimité du système de justice pénale sous trois aspects : l’axiologie, le contexte et la téléologie. Du point de vue axiologique, il est revendiqué le rôle de protection des biens juridiques en interdisant les conduites matériellement offensives. Au niveau du contexte, le système pénal requiert une intervention qui ne soit pas tardive, pour ne pas exclure ou affaiblir la nécessité de la peine. L’ordre téléologique spécifie que la sanction pénale assure l’adoption de la Loi, la protection de la victime et la réinsertion du délinquant, avec la moindre affliction possible.

[EN] Analyses the legitimacy of the penal system from three different points of focus: from an axiological, contextual and teleological standpoint. At the axiological level, it defends its function of exclusive protection of legal goods through the prohibition of materially offensive behaviour. At the contextual level, it calls for intervention that is not too late to exclude or reduce the need for legal punishment. At a teleological level, it stipulates that legal punishment guarantees, with a minimum of hindrance, the enforcement of the law, the protection of the victim and the rehabilitation of the offender.
