Valor de las diligencias practicadas por la policía judicial en el proceso penal

Abstract

[ES] En el procedimiento penal por delitos, les corresponde al Juez de Instrucción, al Fiscal, a la Policía Judicial, a las partes acusadoras y al propio acusado buscar la verdad material o real durante la fase de investigación. Nada llega probado al juicio oral, y el atestado policial, así como los datos de investigación policial que constan en el mismo, tienen, en principio, únicamente valor de denuncia. Ahora bien, en dichos atestados se pueden encontrar diligencias de distinta significación, ya que la Policía Judicial desempeña funciones que alcanzan un muy especial relieve cuando inciden en el proceso penal.

[FR] Selon la procédure pénale, il correspond au Juge d’Instruction, au Procureur, à la Police judiciaire, à l’accusation et au propre accusé de chercher la verité materielle ou réelle tout au long de la phase d’investigation. Rien n’est prouvé préalablement au jugement oral: l’attestation policière ainsi que les données des enquêtes policières y presentées n’ont -en principe- qu’une valeur de plainte. En tout cas, on peut y trouver des diligences de très différentes significations, car la Police judiciaire developpe des fonctions d’une très spé- ciale importance lorsqu’elles touchent la procédure pénale.

[EN] In the penal procedure, to seek the real truth during the phase of investigation is the responsability of the Examining Magistrate, the Public Prosecutor, Judicial Police, the accuser parts ant the accused. Nothing is proved until the oral judgement, and the police reports, the same as the police data investigation that it includes, only have a reporting value. However, in these reports it can be finded some data with different significance, because Judicial Police fulfils some functions that have a very special importance when affect the penal process.
