Gizarte-ekonomia eta gizarte-enpresak: krisi garaitarako irtenbide bat eta aukera juridiko desberdinak

Abstract

It is widely accepted that, in times of economic crisis, business models based on ethical behaviour and social impact work better than business models based on greed and exploitation. On the basis of this working hipothesis, the paper analizes on the one hand the benefits from the social economy in times of economic adversity. On the other hand it pays attention to social enterprises. Spanish law does not provide for any set structure but it provides other tools that can be used to create them. Such tools will be analized using the European approach to the social enterprise.; Existe un pensamiento bastante extendido en nuestra sociedad según el cual las empresas de economía social, en general, se adecúan mejor a las épocas de crisis que las empresas capitalistas. Partiendo de esa idea, en este artículo nos centraremos en los beneficios que ofrece la economía social en una situación de crisis económica y, asimismo, profundizaremos en las empresas sociales. A falta de una base legal firme en la legislación española, analizaremos las diferentes posibilidades existentes en Derecho para la creación de tales empresas, sirviéndonos para ello de la perspectiva europea.; Gure gizartean bada nahiko zabaldua dagoen pentsamendu bat, alegia, gizarteekonomiako enpresak oro har enpresa kapitalistak baino hobe egokitzen direla krisi garaitara. Ideia hori abiapuntu hartuta, lan honetan, batetik, krisi ekonomikoaren aurrean gizarte-ekonomiak eskaintzen dituen onurak behatuko ditugu. Bestetik, berriz, gizarte-enpresatan erreparatuko dugu. Espainiar legedian oinarri sendorik ezean, halako enpresak sortzeko zuzenbidean aurki daitezken aukera desbedinak aztertuko ditugu, horretarako ikuspegi europarraz baliatuaz.
