Los presos FIES: la posible vulneración de los derechos humanos y la consiguiente dificultad de reinserción social de los mismos

Abstract

[ES]El propósito principal de este estudio es examinar el sistema penitenciario desde una perspectiva que garantice los derechos humanos de las personas que se encuentran privadas de libertad dentro del régimen FIES. Evaluaré la legitimidad de los métodos utilizados en este régimen especial, en relación con los principios constitucionales que rigen nuestro sistema penitenciario, tomando en cuenta si son proporcionales y justificados. Además de eso, se analizarán las problemáticas tanto formales como prácticas existentes en relación con el régimen FIES. Por último, enfocándome en la calidad de vida de los internos lograré hacer un analisis sobre su capacidad para reintegrarse a la sociedad una vez liberados, considerando también las medidas que se implementan en las instituciones penitenciarias y su impacto en la vida cotidiana de los reclusos. En resumen, mi análisis buscará determinar si las medidas adoptadas por el sistema penitenciario son efectivas en la consecución de sus objetivos y si cumplen con los estándares legales y éticos.

[EN]The main purpose of this study is to examine the prison system from a perspective that guarantees the human rights of individuals who are deprived of their liberty within the FIES regime. I will evaluate the legitimacy of the methods used in this special regime, in relation to the constitutional principles that govern our prison system, taking into account whether they are proportional and justified. In addition, I will analyze the formal and practical issues related to the FIES regime. Lastly, focusing on the quality of life of inmates, I will analyze their ability to reintegrate into society once released, considering the measures implemented in penitentiary institutions and their impact on the daily lives of prisoners. In summary, my analysis will seek to determine whether the measures adopted by the prison system are effective in achieving their objectives and whether they comply with legal and ethical standards.
