Balance de la legislación y la jurisprudencia de la comunidad foral de Navarra 1979-2019

Abstract

This article brings together the main regulations and rulings in the field of language law that have appeared over the last 40 years in the autonomous community of Navarra, which still lags far behind the autonomous community of the Basque Country in this field. The framework arising from the Spanish Constitution and its own Statute has permitted the passing of Regional Law (Ley Foral) 18/1986, of 15 November, on the Basque Language. This law has been slightly amended on two occasions in recent years (2010 and 2017) in the aim of expanding the language-related rights of those living in Navarra, mainly those residing in its non-Basque-speaking area. The obligation to divide the autonomous community of Navarra into language-speaking areas (Basque, mixed and non-Basque), established by Article 9.2 of Organic Law 13/1982, of 10 August, on the Reintegration and Enhancement of the Regional Regime of Navarra, remains one of the chief obstacles to effectively protecting the Basque language in Navarra and the language rights of its residents.
