Análisis de la figura de la legítima en el Derecho Comparado

Abstract

[spa] El propósito del presente trabajo consiste en el estudio de la figura de la legítima sucesoria tanto a nivel interregional como a nivel europeo. En España encontramos que conviven una gran variedad de figuras de la legítima debido a los Derechos Forales del país. Cuando estas se intercomunican debemos atender nuestro Código Civil para que proporcione la solución a los conflictos sobre la legítima. No obstante, nos encontraremos con una gran variedad de problemas interpretativos y aplicativos de esta regulación. A nivel europeo, diversas figuras de la legítima conviven bajo el Reglamento 650/2012 dando lugar a conflictos internacionales de la legítima. Aunque el Reglamento 650/2012 introduce algunos mecanismos para resolverlos, aún no es del todo completo, dando lugar a diferentes interpretaciones de sus normas por la doctrina y jurisprudencia

[eng] Our paper aims to study the figure of the reserved share both at interregional and European levels. In Spain we find that a great variety of figures of the reserved share coexist due to the Foral Laws of the country. When these collide, we must look to our Civil Code to obtain solutions for the conflicts over the reserved share. However, we will find a broad variety of interpretative and application problems of this regulation. At the European level, different figures of the reserved share coexist under Regulation 650/2012, giving rise to international conflicts of the reserved share. Although Regulation 650/2012 introduces some mechanisms to resolve them, it is still not entirely complete, leading to diverse interpretations of its rules by doctrine and case law.
