Multi-door courthouse: el paradigma del siglo XXI ¿Una posibilidad en España? La mediación como puerta preferente

[spa] El contexto global en el que vivimos ha puesto en una encrucijada al sistema judicial. A nivel internacional, los Estados convergen en la necesidad de dotar a la Administración de Justicia de una nueva estructura que la vuelva eficiente en aras de recuperar la confianza de los ciudadanos. En este sentido, el multi-door courthouse se presenta como el nuevo paradigma del presente siglo porque da respuesta a las actuales necesidades sociales y jurídicas. Realizamos un recorrido por el origen histórico del concepto, su evolución, características y trascendencia actual. Pasamos entonces a explicar el recibimiento, en la Unión Europea, del movimiento que envuelve este modelo y el especial interés que le prestan las instituciones comunitarias a la relación entre los tribunales y la mediación. Esta coyuntura nos ayudará a comprender el marco legislativo en España e intuiremos si el sistema multipuerta es una posibilidad en el futuro próximo.

[eng] The judicial system stands today at a crossroads due to the contemporary global context. At the international level, states are faced with the need to give a new structure to their Administration of Justice, making it efficient in order to regain the trust of citizens. In this regard, the multi-door courthouse appears to be the new paradigm of this century since it meets current social and legal needs. We make a journey that begins by explaining the historical origin of the concept, its evolution, characteristics and current significance. Then we go on to explain the reception, in the European Union, of the movement involving this model and the special interest devoted by the European institutions to the relationship between courts and mediation. This juncture will help us to understand the Spanish legislative framework and we will intuit whether the multi-door system is a possibility in the foreseeable future.
